1.1 This Privacy Policy explains how SAARTHI (“SAARTHI”, “we”, “us”, “our”), a sole proprietorship business having its registered office at Vaishali Nagar, Jaipur, Rajasthan – 302021, India, collects, uses, discloses, stores, and protects personal information in connection with the website https://saarthionline.com (the “Website”) and your purchase of Products through it.

1.2 This Policy applies to all visitors to, and users of, the Website, whether or not you create an Account or place an Order, and describes our practices regardless of the device you use to access the Website.

1.3 This Policy should be read together with SAARTHI’s Terms and Conditions, which govern your use of the Website and any purchase you make, and, where applicable, SAARTHI’s Shipping & Delivery Policy and Return, Refund, Replacement & Cancellation Policy (the “Returns Policy”). This Policy addresses only the collection, use, and protection of personal information, and does not itself set out the commercial terms of any purchase, which are addressed in the Terms and Conditions.

1.4 By accessing or using the Website, you acknowledge that you have read and understood this Policy. Where your consent is required by applicable law for a particular processing activity, we will seek that consent separately, in the manner described in this Policy.

2. Definitions

In this Policy, the following capitalised terms have the meanings given below, unless the context requires otherwise. Other capitalised terms are defined where they first appear.

  • “Account” means a registered user account created by a Customer on the Website.
  • “Cookies” means small text files placed on your device when you visit the Website, as described in Section 5.
  • “Marketing Communications” means promotional or advertising communications sent by SAARTHI, as described in Section 14.
  • “Order” means a request to purchase Products submitted through the Website, as defined in SAARTHI’s Terms and Conditions.
  • “Personal Information / Personal Data” means any information that identifies, or could reasonably be used to identify, an individual, as described in Section 4.
  • “Processing” means any operation performed on Personal Information, including its collection, storage, use, disclosure, and deletion.
  • “Products” means the physical products, including handcrafted, made-to-order, and customized products, offered for sale on the Website.
  • “Returns Policy” means SAARTHI’s Return, Refund, Replacement & Cancellation Policy, as described in Section 1.3.
  • “SAARTHI / we / us / our” has the meaning given in Section 1.1.
  • “Service Providers” means third parties engaged by SAARTHI to perform functions on its behalf, as described in Section 9.
  • “Website” has the meaning given in Section 1.1.
  • “You / your / Customer / User” means any natural person who accesses or uses the Website.

3. Scope of This Policy

3.1 This Policy applies to Personal Information collected by SAARTHI through the Website, through direct communication with SAARTHI (including by email, telephone, and WhatsApp), and in connection with the placement and fulfilment of Orders.

3.2 This Policy does not apply to the practices of third parties that SAARTHI does not own or control, including third-party websites you may access through links on the Website, or third-party Service Providers with their own privacy policies, as further described in Section 9 and Section 16.

4. Information We Collect

4.1 Information You Provide to Us

We collect personal information that you provide to us directly, including when you create an Account, place an Order, contact customer support, submit a review, or subscribe to our newsletter. The categories of information we may collect from you are set out below.

Not every Customer will provide every category of information listed above. The information we actually collect from you depends on how you interact with the Website — for example, whether you place an Order as a registered user or as a guest, subscribe to our newsletter, or contact customer support.

4.2 Payment Information

We do not collect or store your complete payment card details. Payments are processed securely through third-party payment service providers, who collect and process your payment information directly, in accordance with their own privacy policies and applicable payment card industry security standards. SAARTHI receives only limited information necessary to confirm and process your Order, such as payment status and a partial or tokenised payment reference.

4.3 Information Collected Automatically

When you visit the Website, we, and our Service Providers, may automatically collect certain information about your device and how you interact with the Website, including device type, browser type and version, operating system, IP address, pages visited, time spent on pages, session information, the website that referred you to the Website, clickstream data, and analytics information, as further described in Section 6 (Google Analytics). This information is generally collected in a form that does not, on its own, directly identify you by name, but may be combined with other information we hold about you where you are a registered user or have placed an Order.

4.4 Sensitive Information

SAARTHI does not intentionally collect sensitive categories of personal information, such as information relating to health, religion, caste, or biometric data, through the Website. We ask that you do not include such information in any communication with us, including customer reviews or customer support messages, unless specifically and lawfully requested by SAARTHI.

5. Cookies

5.1 The Website uses Cookies and similar tracking technologies. Cookies are small text files that a website places on your device to store information about your visit.

5.2 We use Cookies for a range of purposes, including to keep you logged in to your Account; maintain the contents of your shopping cart between visits; remember your preferences; help protect the security of the Website and detect and prevent fraud; measure and improve the performance of the Website; and analyse how visitors use the Website, as described in Section 6 and Section 7. Cookies are not used solely for shopping cart functionality, and this Policy should not be read as limiting our use of Cookies to that purpose alone.

7.3 SAARTHI does not use your personal information to make decisions based solely on automated processing that produce legal effects concerning you, or that similarly significantly affect you, without human involvement.

7.4 We may create aggregated, anonymised, or de-identified information from the personal information described in Section 4, which no longer identifies you. We may use and share such aggregated or de-identified information for any lawful business purpose, including research, reporting, and analytics, without further restriction under this Policy, provided that it cannot reasonably be used to re-identify you.

8. Legal Bases for Processing

8.1 Where required by applicable law, SAARTHI processes personal information on one or more of the following legal bases:

  • (a) performance of a contract with you, including to process and fulfil your Order;
  • (b) compliance with a legal obligation, including tax and accounting requirements;
  • (c) our legitimate interests, including operating and improving the Website, preventing fraud, and maintaining security, provided that such interests are not overridden by your rights; or
  • (d) your consent, including in relation to Marketing Communications and non-essential Cookies, which you may withdraw at any time as described in Sections 5.3, 13, and 14.

9. How We Share Your Information

9.1 SAARTHI does not sell your personal information.

9.2 We may share your personal information with trusted Service Providers where necessary to operate the Website and fulfil your Orders, as set out below.

9.4 In the event of a merger, acquisition, reorganisation, financing, or sale of all or part of SAARTHI’s business or assets, your personal information may be transferred to the acquiring or surviving entity as part of that transaction, subject to this Policy or a materially similar policy adopted by that entity.

9.5 This Section 9 does not limit the disclosures described in Section 10 (International Data Transfers) or Section 4.2 (Payment Information).

10. International Data Transfers

10.1 SAARTHI ships Products worldwide, and, as a result, your personal information may be processed or stored in India and in other countries where SAARTHI’s Service Providers operate, which may have data protection laws that differ from those in your own country.

10.2 Where your personal information is transferred to, or processed in, a country other than your own, SAARTHI takes reasonable steps to ensure that it continues to be protected in a manner consistent with this Policy and applicable law.

11. Data Security

11.1 SAARTHI implements reasonable administrative, technical, and organizational safeguards designed to protect your personal information against unauthorised access, disclosure, alteration, and destruction, including the use of SSL/TLS encryption to protect data transmitted between your browser and the Website.

11.2 These safeguards include restricting access to personal information to personnel and Service Providers who reasonably require it to perform their functions, requiring that personnel and Service Providers handle personal information in a manner consistent with this Policy, and relying on reputable, security-conscious payment gateway, hosting, and courier partners, as described in Section 9.

11.3 If SAARTHI becomes aware of a security incident that compromises your personal information in a manner that requires notification under applicable law, we will notify affected individuals and, where required, the relevant regulatory authority, in accordance with that law and without undue delay.

11.4 While we take reasonable steps to protect your personal information, no method of transmission over the internet, and no method of electronic storage, is completely secure, and we cannot guarantee absolute security.

11.5 You are responsible for maintaining the confidentiality of your Account login credentials and for any activity that occurs under your Account, as further described in SAARTHI’s Terms and Conditions.

12. Data Retention

12.1 We retain your personal information only for as long as reasonably necessary for the purposes for which it was collected, including to fulfil your Orders and provide after-sales support; maintain business records; comply with legal, tax, and accounting obligations; prevent fraud; and resolve disputes.

12.2 Where personal information is no longer required for these purposes, we take reasonable steps to delete, anonymise, or securely dispose of it, save where we are required by applicable law to retain it for a longer period. Further information regarding the retention of inactive Account data is set out in SAARTHI’s Terms and Conditions.

12.3 The table below sets out, by way of general guidance, the typical retention approach applied to the main categories of personal information described in Section 4. Specific retention periods may vary depending on applicable statutory limitation periods, tax and accounting requirements, and the circumstances of an individual Order or Account.

13.1 Subject to applicable law, you may have the right to:

  • (a) request access to the personal information we hold about you;

  • (c) update your Account details directly through the Website;
  • (d) request deletion of your personal information, where applicable and subject to our legal and legitimate business retention needs described in Section 12; and
  • (e) withdraw your consent to Marketing Communications, or to non-essential Cookies, at any time, as described in Sections 5.3 and 14.

13.2 To exercise any of these rights, please contact us using the details in Section 19. We will respond to your request within a reasonable time and in accordance with applicable law. Certain rights may not be available, or may be subject to conditions or exceptions, depending on your jurisdiction and the nature of your request, and exercising certain rights, such as deletion of information necessary to process an active Order, may affect our ability to provide our services to you.

13.3 If applicable data protection law in your jurisdiction, including laws such as India’s Digital Personal Data Protection Act or the General Data Protection Regulation applicable in the European Union and United Kingdom, grants you rights in addition to those described in Section 13.1, those additional rights are available to you, and may be exercised using the contact details in Section 19, to the extent required by that law.

13.4 We may need to verify your identity before acting on a request made under this Section 13, to ensure that we do not disclose or act upon your personal information at the request of an unauthorised person.

14. Marketing Communications

14.1 Where you have subscribed to our newsletter, or otherwise consented to receive Marketing Communications, we may send you promotional and marketing content by email, SMS, or WhatsApp, relating to Products, offers, and updates from SAARTHI.

14.2 You may opt out of Marketing Communications at any time by using the unsubscribe link included in marketing emails, by responding to opt out of WhatsApp or SMS communications where that option is offered, or by contacting us using the details in Section 19.

14.3 Opting out of Marketing Communications does not affect our ability to send you transactional communications relating to your Orders or Account, such as order confirmations, shipping updates, and responses to customer support enquiries.

15. Children’s Privacy

15.1 The Website is not directed to children, and SAARTHI does not knowingly collect personal information from individuals who do not have the legal capacity to provide it without the involvement of a parent or guardian, as further described in SAARTHI’s Terms and Conditions.

15.2 If we become aware that we have inadvertently collected personal information from such an individual without appropriate authorisation, we will take reasonable steps to delete that information.

16. Third-Party Links

16.1 The Website may contain links to third-party websites, including social media platforms, courier tracking pages, and payment gateway pages. This Policy does not apply to those third-party websites, which have their own privacy practices.

16.2 We encourage you to review the privacy policy of any third-party website before providing personal information to it.

17. Artificial Intelligence

17.1 SAARTHI may use artificial intelligence-assisted tools in connection with the operation of the Website and its business, including in relation to product content, customer support, and Website functionality.

17.2 SAARTHI’s use of such tools does not change SAARTHI’s responsibility for handling your personal information in accordance with this Policy, and any personal information processed using such tools remains subject to the protections described in this Policy.

18. Changes to This Privacy Policy

18.1 SAARTHI may update this Policy from time to time to reflect changes in our practices, technology, legal requirements, or otherwise. The updated Policy will be posted on the Website with a revised “Last Updated” date and, where required by applicable law, we will notify you of material changes.

18.2 Your continued use of the Website following the posting of an updated Policy constitutes your acknowledgment of the updated Policy.
